Since the last edition in 2006, the law of confidentiality has seen significant changes. Prominent among them have been the continuing development of a Convention-based law of privacy and the difficulties of jurisprudential integration which it presents. The third edition addresses these and other topical issues. Leading cases which are covered in the third edition include: Douglas v Hello! Ltd (in the House of Lords)

  • R (L) v Commissioner of Police of the Metropolis
  • Al Rawi v Security Services
  • Associated Newspapers v Prince of Wales
  • Emmott v Michael Wilson & Partners Ltd
  • JIH v News Group Newspapers Ltd
  • McKennitt v Ash
  • Thomas v Farr
  • Tchenguiz v Imerman
  • Comissioner of Police of the Metropolis v Times Newspapers Ltd
  • Farm Assist Ltd v Secretary of State for the Environment, Food and Rural Affairs (No.2)

There is also an expanded treatment of civil procedure in relation to anonymity and other restrictions on litigation publicity. The book’s principal focus is on the law of England and Wales, but account has also been taken of recent case-law in other common law jurisdictions. Sir Roger Toulson is a former Chairman of the Law Commission, a Lord Justice of Appeal and a Master of the Bench of the Inner Temple. Charles Phipps is a barrister of the Middle Temple.
